Howard Knopf has yet another excellent post with respect to Teksavvy’s possible direct responsibilities to its customers under privacy law, and if they do not act on it directly, could throw a lot of imbalance around privacy into the system and into future copyright cases going forward. That could also have profound social impacts going forward.
